Foreclosure (Residential)
When you are behind in your mortgage payments, we can assist you in
exploring possible alternatives including workouts and refinancing.
If your mortgage lender has initiated a foreclosure proceeding
against you, we will assist in your defense of that action and
provide you with creative solutions, which may allow you to either
retain your property or maximize any equity that you have built in
your property.
Business

Home
Improvement Contractor Registration
If you are doing business as a
home improvement contractor in the State of Connecticut, the law
requires that you register with the Department of Consumer
Protection. The State requires you to register if you perform work
on a residential property, whether it be a single family home or
multifamily dwelling of 6 units or less or a condominium or common
interest community, and you make $1,000 in one (1) calendar year by
performing such work. Additionally, you must provide your customer
with both a written Home Improvement Contract and a Notice of
Cancellation. Home improvement includes, but is not limited to, the
repair, replacement, alteration, conversion, modernization,
improvement, rehabilitation or sandblasting of, or addition to any
land or building or any portion thereof which is used or designated
to be used as a private residence, dwelling place or a residential
property or the construction, replacement, installation or
improvement of dwellings, residential rental property, or the
construction, replacement, installation or improvement of
driveways, swimming pools, porches, garages, roofs, siding,
insulation, solar energy systems, flooring, patios, decks,
landscaping, fences, windows and many others.
If you fail to register as a Home
Improvement Contractor or fail to provide your customer with a
written Home Improvement Contract or Notice of Cancellation, the
State may impose civil and/or criminal penalties, and you may find
yourself unable to collect for services you have already provided
to the consumer. We have experience identifying if you and/or your
business needs to register under the act, and will prepare all
contracts and notices for your use pursuant to said act.
Probate
Whether you need representation with administration of an
estate, conservatorships, guardianships, termination of parental
rights or removal of guardians, change of name or adoption, we can
assist your needs. We have several years of experience practicing
before the various Probate Courts in Connecticut, and have been
appointed by numerous Probate Judges to administer estates,
represent children, act as guardian or conservator on behalf of
individuals unable to handle their own affairs, defend the rights
of parents and work toward settling complex estate disputes.
Criminal
Representation of individuals charged with a crime as a result
of motor vehicle violations, driving while impaired or intoxicated,
shoplifting, domestic disputes, misdemeanors and felonies.
Landlord/Tenant
Representation of landlords or tenants in lease and other
contract negotiations and preparation, commencement and defense of
eviction proceedings due to non-payment of rent, lapse of time or
other nuisances caused by tenant. The laws of Connecticut
pertaining to eviction proceedings and return of security deposits
are complex and mandatory failure to follow the proper procedures
may result in your payment of damages to the tenant or the tenants
continued occupancy of your property.
Divorce and Family Law
Getting divorced is an important decision. We can assist you in
identifying issues concerning your marriage and your decision to
commence an action for divorce or defend one as the case may be.
There are many stages to a divorce and many cases can be settled
without the necessity of court intervention through skillful
negotiation and knowledgeable representation by your
attorney.
Mechanically, an action for dissolution of marriage (divorce)
is a lawsuit brought by one spouse against the other. There are no
negative connotations attributable to either the spouse who brings
the action or the spouse who defends the action. There are three
classifications to divorce; CONTESTED: almost all issues are in
dispute, including custody of the children; LIMITED CONTESTED:
monetary issues are primarily in dispute; and UNCONTESTED: the
parties have agreed to all issues including the division of assets,
custody of children and payment of child support and/or alimony.
Many cases that appear to be, or begin as contested cases, are
resolved as uncontested cases through the hard work and diligence
of both the parties and their attorneys. If the parties are able to
reach an agreement on all of the issues, they proceed with an
uncontested divorce hearing and must appear at a short and simple
final hearing before a Judge who reviews the agreement of the
parties and their financial affidavits before approving the
settlement.
One
of the most frequent questions asked of us is: How long will a
divorce take? In Connecticut there is a ninety (90) day waiting
period from the time your complaint is returned to the Court, after
first being served on your spouse by Sheriff, and the final
hearing. A dissolution of marriage, even an uncontested matter,
cannot be granted prior the ninety day period and may take up to
120 days, adding time for the service and filing of the action.
Limited contested and contested matters cannot be gauged in the
amount of time they will take; each is case specific depending on
the issues and the ability of the parties to work them out. The
fewer issues the parties can resolve on their own the more likely
it is that court intervention will be necessary thus extending the
time between the return date and the final divorce hearing. In my
experience, fully contested divorce actions where property
division, custody and alimony issues are in dispute may take in
excess of a year to resolve.
Attorney’s fees are based on many factors, some of them
include, the time expended, the complexity of issues involved and
the ability of the parties to work together to settle some of the
less difficult issues. Most attorneys will require that a retainer
be paid at the beginning of the action. A retainer is an advance
against the final fee and is typically not the final fee. We will
provide you with a written retainer agreement, which outlines our
fees, what will be expected of you and required of us and our
office.
