Divorce Law and Family Law

Attorney Ferraro operates a well established law firm located in Norwalk CT, and is an experienced divorce attorney that can assist you with issues pertaining to child custody, child supportfamily law, divorce issues, paternity, parentage, spousal support, modifications, after divorce, post-divorce, prenuptial agreements, alimony, property division, property settlement, uncontested limited contested and contested divorce trials. Attorney Ferraro is an experienced lawyer who has concentrated on divorce law and family law since 1991. Attorney Ferraro can answer all of your questions pertaining to child custody, child support, family law, divorce issues, paternity, parentage, spousal support, modifications, after divorce, post-divorce, prenuptial agreements, alimony, property division, property settlement, uncontested limited contested and contested divorce trials.

Getting divorced is an important decision. We can assist you in identifying issues concerning your marriage and your decision to commence an action for divorce or defend one as the case may be. There are many stages to a divorce and many cases can be settled without the necessity of court intervention through skillful negotiation and knowledgeable representation by your attorney.

Mechanically, an action for dissolution of marriage (divorce) is a lawsuit brought by one spouse against the other. There are no negative connotations attributable to either the spouse who brings the action or the spouse who defends the action. There are three classifications to divorce; CONTESTED: almost all issues are in dispute, including custody of the children; LIMITED CONTESTED: monetary issues are primarily in dispute; and UNCONTESTED: the parties have agreed to all issues including the division of assets, custody of children and payment of child support and/or alimony. Many cases that appear to be, or begin as contested cases, are resolved as uncontested cases through the hard work and diligence of both the parties and their attorneys. If the parties are able to reach an agreement on all of the issues, they proceed with an uncontested divorce hearing and must appear at a short and simple final hearing before a Judge who reviews the agreement of the parties and their financial affidavits before approving the settlement.

One of the most frequent questions asked of us is: How long will a divorce take? In Connecticut there is a ninety (90) day waiting period from the time your complaint is returned to the Court, after first being served on your spouse by Sheriff, and the final hearing. A dissolution of marriage, even an uncontested matter, cannot be granted prior the ninety day period and may take up to 120 days, adding time for the service and filing of the action. Limited contested and contested matters cannot be gauged in the amount of time they will take; each is case specific depending on the issues and the ability of the parties to work them out. The fewer issues the parties can resolve on their own the more likely it is that court intervention will be necessary thus extending the time between the return date and the final divorce hearing. In my experience, fully contested divorce actions where property division, custody and alimony issues are in dispute may take in excess of a year to resolve.

Attorney’s fees are based on many factors, some of them include, the time expended, the complexity of issues involved and the ability of the parties to work together to settle some of the less difficult issues. Most attorneys will require that a retainer be paid at the beginning of the action. A retainer is an advance against the final fee and is typically not the final fee. We will provide you with a written retainer agreement, which outlines our fees, what will be expected of you and required of us and our office.

Attorney Ferraro is experienced at representing both spouses and children in divorce and other family matters. We can assist you in all aspects of your case. If your dissolution action is contested, we will provide you with a legal analysis on property division, alimony, child support and custody. This will not be a “set-in-stone” picture of which your settlement will be, however it may give you a clearer picture of the options and outcomes which are available to you. Do not be fooled by an attorney who provides you with concrete answers and settlement figures at an initial consultation meeting, seek the advice of an experienced attorney.
